1. - REM Email To Warden Of Retaliation (The following is from an email sent to the Warden of USP Tucson on 4/21/2015) I am writing to inform you of the clear and present retaliation against myself,and my cellmate, today, in cell 117. Today, at lunch, we were on lockdown and were to be fed by the officers. At about 12:50pm, the team of Hansen, Lewis and Officer L. Ybarra came out to pass out the meals to all the inmates, who were on lockdown. As they came to our cell (117), I saw Unit Manager Hansen and Case Manager Lewis passing out the meals; I didn't want to say anything to them, in light of the fact that this unit has put me on FRP Refusal based on bad advice from Ms. Flores and I am STILL on FRP Refusal, even though I have sent them the receipt paid on April 8th, 2015 and sent by cop—out to Flores last Wednesday. There is no reason I should still be on FRP Refusal, unless there is retaliation for me writing to the District Court about this matters. So today, as they were passing out the boxed lunches, I told my cellmate that I didn't want to talk or even see them, because I am convinced they were retaliating against me. So I sat down at the desk, and continued writing an essay. As the staff came by the door, with the trap door open, the female officer (Ybarra) came and handed my cellmate ONE box lunch. Immediately afterwards my cellmate called her and said, "Hey! There's TWO in here!" Ybarra said to my cellmate, "That's what they gave you." How could she say that if they were supposed to look INSIDE the cell to see how many inmates were in the cell, count the number, and hand the appropriate number to the inmates? Officer L Ybarra kept moving, ignoring my cellmate request for another box. It is very clear that Hansen and Lewis heard him, and in fact LOOKED INSIDE the cell, and kept moving. They never came back to give us another box. It is also clear that the team is retaliating against me because of the emails I have sent, regarding not only the FRP issue, but the issues regarding safety in the SHU. There can be no acceptable excuse for this. I have a right to eat, which staff clearly denied because of a vendetta against me. When inmates do wrong, they are punished quickly; what do you do when staff abuses their authority and break the rules, and LAWS regarding feeding inmates. I say again, Hansen, Lewis and Ybarra clearly knew how many inmates were in that cell, and yet refused to feed us, targeting me directly. How then are we supposed to respect officers if they abuse their authority? To today I don't get to eat lunch, because staff felt that they had the right to refuse me. If any officer (Hansen, Lewis or Ybarra) says they didn't know, I will call them a liar, because they clearly knew. What will they do to me next in retaliation? If they are willing to deny me a meal, can physical abuse be far behind? Will they ship me without my acknowledgement? What should I do except report this to the Department of Justice? If you have a more peaceful solution, I am all ears, because I don't like being abused like this. Those officers did a most ungodly thing, in denying me food. Heaven knows what would have happened if I was in the SHU. Please resolve this as soon as possible.
